Comprehensive Fire Safety and Emergency Action Plans provide the procedures for occupants of the building during fire or non-fire emergencies. The plans also provide first responders with an understanding of the building’s fire protection systems, layout and contents of the building, means of egress, fire hazards, and identification of key contacts during an emergency.

Section 401.3.6.1 of the 2014 Fire Code provides that the emergency preparedness plan requirements of the 2008 Fire Code remain in effect until new rules are adopted to implement the emergency preparedness plan requirements of the 2014 Fire Code.

Section 404.2.2 of the 2008 Fire Code requires the Comprehensive Fire Safety and Emergency Action Plans for the following Group B occupancy office buildings or parts thereof:

Exception: Office buildings that have lawfully installed an interior fire alarm system.

Section 404.3 of the 2008 Fire Code requires the owner of premises subject to provisions of Section 404.2.2 to prepare the plans in a form described in the 3 RCNY 404-02 and submit to the Department for review and acceptance.

Additional Information:

  • Completely follow the guidelines provided with all information as requested (in Chapter 4 of the 2008 Fire Code and Fire Department rule 3 RCNY)
  • All revised (Amended) plans requires a new Owner’s Certification page with all required documents.

If you are filing an amendment, you can now access previous FDNY records by providing your reference account number (FPIMS #) and premises zip code. It is highly recommended that you link your previous record, which can be done at the beginning of the application.

Upon review, the applicant will receive one of the following:

  • Letter of Deficiency, if any of the requirements for the Comprehensive Fire Safety and Emergency Action Plans are not met. All deficiencies must be corrected and submitted within 30 calendar days from the date listed on the issued Letter of Deficiency unless otherwise specified. Amended application fees will apply if the corrections are not submitted within the allocated time.
  • Letter of Acceptance after the application has been approved and all required paper copies of the plan with all appendices and compact disks containing the Comprehensive Fire Safety and Emergency Action Plans and floor plans have been filed with the Department.
  • Special Conditional Acceptance Notice to facilitate Temporary Certificate of Occupancy (TCO) or to allow for the scheduling of on-site appointment, if the plan has met or exceeded the minimum requirements for the Comprehensive Fire Safety and Emergency Action Plans but without the FSP staffing.
An application shall be deemed abandoned 180 calendar days after the date of filing, unless such application has been diligently prosecuted or a Letter of Acceptance has been issued.
Within 30 days from the date of Department acceptance of the Comprehensive Fire Safety and Emergency Action Plans, an owner shall have in place trained FSP staff and otherwise be capable of implementing the plans at the premises.
Any educational materials regarding the Comprehensive Fire Safety and Emergency Action Plans shall be promptly distributed to all building occupants.
Copies of the Comprehensive Fire Safety and Emergency Action Plans and Building Information Card shall be readily available on the premises at a fire command center or other appropriate location.
Comprehensive Fire Safety and Emergency Action Plans shall be reviewed and updated annually or necessitated by changes of use or occupancy, or the design and arrangement of the premises.
Changes in FSP staffing designated in the plans, excluding fire safety/EAP wardens and deputy fire safety/EAP wardens, shall be reported to the Department by filing a change in FS/EAP staff amendment on not less than a semi-annual basis.
Entries documenting the review and indicating the general nature of any amendments to the plans shall be maintained within an approved type of log book.
Submit the completed application online with all supporting documents.
