The NYC Construction Codes require owners to build and keep their properties safe. Inspectors from the Department of Buildings (DOB) issue violations and Office of Administrative Trials and Hearings (OATH) Summonses when a property or construction does not follow these codes, the Zoning Resolution, and other laws.
- Commissioner's Order: Each violation or summons includes a Commissioner's Order to fix the problem and to certify the correction with the Department.
- Public information: Violation information is public and will show up in a property title search.
- Impact on property transactions: Open violations can stop an owner from selling or refinancing.
- Certificates and Letters: The Department will not issue new or amended Certificates of Occupancy or Letters of Completion if violations are still active.
