Businesses that will discharge industrial wastewater must comply with the Sewer Use Regulations established in Title 15 of the Rules of the City of New York (RCNY) Chapter 19.

Different types of industrial wastewater discharge are associated with different requirements. Please refer to CFR Title 40, Parts 400 to 610, linked below under Additional Information to learn which businesses must obtain an industrial wastewater discharge permit before discharging wastewater to New York City’s public combined and/or sanitary sewers. Please note that businesses discharging an average of 25,000 gallons per day or more of process wastewater may also need to obtain a discharge permit regardless of the type of industry in which they operate.

Permits expire after 5 years and are automatically reissued by DEP prior to the expiration date. Businesses are expected to comply with the terms of the permit, which include periodically sampling.
Once the applicant has identified the business as one needing a wastewater discharge permit, the applicant should download CFR Title 40, Part 403.12 and follow the instructions to prepare a Baseline Monitoring Report (BMR). Please note that the BMR should be certified by a licensed engineer or a qualified professional. If a qualified professional, who is not a licensed engineer, certifies the BMR, a statement describing their qualifications must be included with the BMR submission.
Mail the BMR to the DEP address below under Contact Information. Alternatively, you may email the BMR to the address given below. Based on the information submitted, engineers at DEP will be able to determine if the business requires a DEP Industrial Wastewater Discharge Permit
If the BMR is found incomplete or unacceptable, DEP will notify the applicant.
After a complete and acceptable BMR is received, DEP will issue an Industrial Wastewater Discharge Permit.
Applicants will receive a response from the DEP within four weeks of submission.
