Performance based design documents include applications that by code require, a computational fluid dynamics and/or fire modelling analysis to be performed in order to analyze a potential fire scenario.

Such analyses may be utilized to predict the ability of a structure or building and its components to withstand the effects of a nearby fire, modeling the fluid motion of the smoke and hot gases.

Performance based design is also used to analyze and predict the ability of people to safely evacuate an area. Appropriate methods of conducting such analyses includes the use of a nationally recognized and validated computational fluid dynamics (CFD) fire modelling program or an equivalent calculation methodology.

Performance based design documents include, but are not limited to, the following types of analyses:

Note: for Fire engineering analyses of a cantilevered building as per Section 705.12 of the 2014 NYC Building Code and Buildings Bulletin 2017-014, the following documents and information should also be submitted in addition to the required documentation in the checklist below:

A TM-1 application that briefly describes the nature of the submission and what code sections or governing documents the application has been filed to comply with a fire engineering analysis report, signed and stamped by a NYS Registered Design Professional (P.E. or R.A.) that describes the analysis performed, its compliance with the relevant code sections and governing documents, and its results. All relevant details should be included in this report.

The simulation files:

  • If Fire Dynamics Simulator (FDS) was used, please submit all input and output files for the simulation conducted.
  • If another nationally recognized CFD program was used, please submit videos of the conducted simulation showing as much of the structure in question or subject of analysis as possible.
If you are filing an amendment, you can now access previous FDNY records by providing your reference account number (FPIMS #) and premises zip code. It is highly recommended that you link your previous record, which can be done at the beginning of the application.
FDNY will review the application and if necessary, contact the applicant to schedule a meeting to discuss the proposal.

After reviewing the application, the following will be issued:

  • Letter of no objection, if FDNY does not have any objections and concerns. The letter will specify the required next steps as applicable for proposal (based on details of specific concept proposal).
  • Letter of deficiency, if FDNY has any objections and concerns.

Application Fees:

  • New Application Fees: $945 (Plan Examination FC 105.4 + New Technology/Technical Analysis including FC102.8 & FC104.9)
  • Amended Application Fees: $945 (Plan Examination FC 105.4 + New Technology/Technical Analysis including FC102.8 & FC104.9)
  • Resubmission Fees: No fee required if submitted within 6 months of Letter of Deficiency. After 6 months, application will be considered abandoned, and may require a new filing fee.
Submit the completed application online with all supporting documents.
