Membership organizations that want to be exempt from the 2002 Smoke Free Air Act must apply to register with the New York City Department of Health and Mental Hygiene (DOHMH).

- Approved registration: This lets the membership association allow smoking. Smoking is only allowed in the areas the association controls.
- The registration is not transferable: It does not cover any other person, association, organization or other entity that may own, lease or be authorized to use the same premises. It only covers the association that applied.
- Upon renewal: The group must still meet the rules for a membership association as defined in the Administrative Code.
