A permit from the Department of Health and Mental Hygiene is required for the installation, drilling, replacement or operation of a water well, water well pump or well pumping equipment used to supply water to buildings in New York City. There are two types of Well Categories: Potable (drinking) and Non-Potable (not for drinking) Wells. One application is used for both types of permits. All permit holders must comply with all applicable requirements outlined in Article 141.17 of the NYC Health Code. (Link below)

All outstanding fines imposed for Health Code Violations must be paid before you can apply for or renew a permit issued by the NYC Department of Health and Mental Hygiene. Fines may be paid in person at the NYC Department of Consumer and Worker Protection (DCWP) Citywide Licensing Center or Online.

Potable well water for drinking purposes applicants must establish that the municipal water supply is not accessible. Applicants must also demonstrate that the water quality of the proposed well will meet the standards as outlined in Subpart 5-1 of the New York State Sanitary Code. This can be verified by the New York City Department of Environmental Protection sampling.
Non-Potable well water for other than drinking purposes applicants must receive a Letter of Approval for Groundwater Discharge to Sanitary or Combined Sewer from the Department of Environment Protection. Please use the appropriate form available in the Links section above.
New proposed well applicants must submit an assessment of the proposed site created by a licensed architect or engineer. The assessment should include: the past land use of the area, and any potential sources of groundwater contamination that may migrate into the well point's cone of depression such as gas stations, chemical plants, landfills, transfer stations, etc.
New proposed well applicants must also submit a map or plan of the property, showing the location of any buildings, proposed well site, property boundaries, and any potential sources of pollution (fuel or septic tanks, solid waste, salt storage, etc.) within 100 feet of the well. A licensed architect or engineer must draft this map.

If you submitted your application in person, DCWP will issue you a receipt. If you submitted your application online, you will receive a receipt via email. A weather proof sign with the words "Danger - Water Unsafe-This well water is NOT to be used for drinking or domestic purposes" shall be clearly, legibly and prominently displayed on each pump tap and outlet connected to the well whose water is not approved for drinking purposes. The lettering on the sign must be at least two inches high.
Well water should not be used for purposes other than those outlined on the permit. The well water supply should be free from cross connection with the building plumbing or the municipal water supply system
No person shall drill, construct or abandon a well without first registering the well with the New York State Department of Environmental Conservation pursuant to New York State Environmental Conservation Law 15-1525.
If a water well is to be sealed or closed, the owner of the property must notify the Office of Public Health Engineering. Every decommissioned or abandoned well must be sealed or closed so as to protect the aquifer from pollution or contaminants, and prevent a hazard to life or property. The Office of Public Health Engineering may require the abandonment of a well which it deems to be contaminated or damaged or which has been constructed or operated improperly.
Applying for an NYC Department of Health and Mental Hygiene (DOHMH) permit does not satisfy the regulatory requirements of other City and State Agencies. It is the business owner's responsibility to apply for all other permits, licenses, and authorizations required by other City and State Agencies. Failure to comply with all relevant regulations, including those under the jurisdiction of other Agencies, may result in the suspension of DOHMH permits until proof of compliance is provided.

Make individual electronic versions of each supporting document for uploading to the system. The following document types can be uploaded: PDF, JPG, GIF, PNG, XLS, XLSX, DOC, DOCX, VSD, and TXT.
Create an account with the NYC Online Licensing system. Payment is required to complete and submit the application so applicants should have their credit or debit card information readily available. Partially completed applications may be saved and returned to later for completion.
Select the type of permit for which you are applying and enter the requested information into each field. Fields with an asterisk (*) are required. Applicants will be requested to upload copies of required documents. Please upload each supporting document individually.
