Correcting and Responding to Violations
A Fire Department of New York (FDNY) violation means a property is not in compliance with the New York City Fire Code and Fire Department Rules and Regulations.
Some violations are minor. Others are dangerous and need immediate action. Sometimes, you might get a criminal court summons. Violations can be found during an FDNY inspection or from complaints.
Types of violations in New York City:
- FDNY Summonses
- Criminal Court Summonses
- Violation Orders
- Vacate Orders
If you get an FDNY Summons, you can admit to the violation and fix it. You must then file a Certificate of Correction with the Fire Department. This certificate shows that you have fixed the problem.
First offenders
To avoid a hearing and penalty, you must send your completed Certificate of Correction form, proof of correction, a copy of the FDNY Summons and all attached pages to the Fire Department's Legal Affairs, Administrative Enforcement Unit. This must be done by the compliance date on the FDNY Summons, which is within 35 days of the date it was issued.
If the Fire Department does not tell you that it has approved your submission before the scheduled hearing date, and has not excused you from the hearing, you must attend the hearing.
How to avoid higher fines and penalties
- If you do not attend your scheduled hearing, you may get higher fines and a default judgment.
- If you have not received a response about your correction submission to FDNY, you can contact OATH (Office of Administrative Trials and Hearings) to reschedule your hearing.
- By rescheduling your hearing, you can avoid higher fines and extra penalties. You still need to fix the violations with FDNY or attend your rescheduled hearing to avoid more penalties and a default judgment.
Important reminder: If the Fire Department does not tell you that it has approved your submission before the scheduled hearing date, and has not excused you from the hearing, you must attend the hearing.
Certificate of Correction (CCR) requests
- You must file CCR requests online.
- Email submissions are no longer accepted.
To submit a CCR:

Log in to FDNY Business.

Select "Initiate Application/Request."

Choose "FDNY Summons Certificate of Correction Request" under "Enforcements."

Even if you show compliance at the hearing, you still need to file a Certificate of Correction.

If you do not respond to an FDNY Summons, you may face a default judgment with maximum penalties.
Criminal Court Summonses
- If you get a Criminal Court Summons, you must go to New York City Criminal Court.
- The summons will tell you the date, time and location of the hearing.

Violation Orders and Vacate Orders
If you get a Violation Order:
- Submit your reinspection request on FDNY Business.
- Attach a copy of the Violation Order.
If you get a Vacate Order:
- Contact the FDNY Customer Service Desk.
- Send all proof of correction to fdny.businesssupport@fdny.nyc.gov.
Submit the application
- Complete the application online with all supporting documents.
Make payment
- You must pay on FDNY Business to submit your application.
- For additional invoiced fees after submission, use one of these methods:

- Pay online at FDNY Business (credit, debit or e-check accepted).
US mail (check must contain FDNY Business Record ID):
