A Fire Department of New York (FDNY) violation means a property is not in compliance with the New York City Fire Code and Fire Department Rules and Regulations.

Some violations are minor. Others are dangerous and need immediate action. Sometimes, you might get a criminal court summons. Violations can be found during an FDNY inspection or from complaints.

Types of violations in New York City:

If you get an FDNY Summons, you can admit to the violation and fix it. You must then file a Certificate of Correction with the Fire Department. This certificate shows that you have fixed the problem.

First offenders

To avoid a hearing and penalty, you must send your completed Certificate of Correction form, proof of correction, a copy of the FDNY Summons and all attached pages to the Fire Department's Legal Affairs, Administrative Enforcement Unit. This must be done by the compliance date on the FDNY Summons, which is within 35 days of the date it was issued.

If the Fire Department does not tell you that it has approved your submission before the scheduled hearing date, and has not excused you from the hearing, you must attend the hearing.
