Hospitals in New York State need two certificates: an Operating Certificate and a Certificate of Need. Both come from the New York State Department of Health (NYSDOH).

First, a hospital needs a Certificate of Need. This certificate shows that the hospital:

After getting the Certificate of Need, the hospital can apply for an Operating Certificate. To get this, the hospital must meet all safety, staffing and operational rules.

Mental institutions and sanitariums are not covered by this certificate.
