Hospitals in New York State need both an Operating Certificate and a Certificate of Need. Both certificates come from the New York State Department of Health (NYSDOH).
First, a hospital needs a Certificate of Need. The certificate shows that the hospital meets a public need, is financially solvent, and is run by qualified people. Then, the hospital can apply for an Operating Certificate. The facility must meet all safety, staffing, and operational requirements.
Mental institutions and sanitariums are not covered by this certificate.
