    A tenant without a direct Con Edison account occupying 10,000 square feet or more, and / or any tenant occupying an entire floor, must be independently sub-metered. Rebates for common areas must be calculated monthly according to program rules, and energy credits must be provided by the landlord to all eligible tenants. All rental invoices to tenants must state that “the tenant is receiving an energy credit through LMEP.” The landlord charge for redistribution of energy may not exceed 12%, and the Department of Small Business Services has the right to request energy surveys to differentiate eligible from ineligible energy uses. Other criteria apply. Public benefit corporations, residential units, hotels, and most retail businesses are not eligible. Industrial businesses should apply through the Energy Cost Savings Program (ECSP), linked above.
