Businesses that release pollutants into the air need permits from the New York State Department of Environmental Conservation (DEC). If your facility emits pollutants at certain levels, you must get a State Facility Permit.
When you need a State Facility Permit
You need a State Facility Permit if your facility meets any one of these conditions:
- Emits more than 12.5 tons per year of either mononitrogen oxides (NOx) or volatile organic compounds (VOCs)
- Emits more than 50 tons per year of sulfur dioxide (SO2), carbon monoxide (CO) or particulate matter (PM)
- Emits more than 5 tons per year of a single hazardous air pollutant (HAP) and 12.5 tons per year (total) of all HAPs
- Emits more persistent, bioaccumulative or toxic compounds than allowed by table 1 in 6 NYCRR ยง201-9
If your business emits less than 50 percent of these major source thresholds, you should submit the Air Facility Registration.
If your facility emits at or above the major source thresholds, you should file for a Title V Permit.
