The New York State Department of Health (NYSDOH) makes rules for tattooing and body piercing.
Tattoo and body piercing shops need a permit and each tattoo and/or piercing artist needs a permit. In New York City, shops must follow health rules from the Department of Health and Mental Hygiene. Permits last up to two years.
Current rules
- Children under 18 cannot get tattoos.
- Body piercing of children requires signed parent consent. Child ear piercing does not need consent.
- Businesses must use new needles for each procedure.
