The Construction Noise Regulation outlined in Title 15 Rules of the City of New York (RCNY) Chapter 28 is part of the Noise Code. The Noise Code establishes policies and standards for administering the Noise Code in New York City as described in Local Law 113. The Construction Noise Regulation sets forth the additional noise mitigation strategies, methods, procedures and technology that must be used at construction sites. Noise mitigation measures are implemented to lessen the impact of noise in the area where construction activities take place.

Construction businesses must use noise mitigation strategies whenever any one or more of the following construction devices or activities listed below are employed or performed:
  • Impact Equipment: Pile Drivers, Jackhammers, Hoe Rams, Blasting
  • Earth Moving Devices: Vacuum Excavators
  • Construction Trucks: Dump Trucks
  • Stationary Devices: Cranes, Auger Drills, Street Plates, Backup Alarms
  • Manual Devices: Concrete Saws
Construction businesses should also review, the Minimal Noise Rule outlined in Title 15 RCNY Chapter 30, which describes a list of construction activities with a minimal noise impact and specific noise mitigation measures applicable to these activities.
